    BIALYSTOK TRIAL SECOND INSTANCE JUDGEMENT

    Tuesday 28th November the second instance judgement concerning“Operation Bialystok” was issued. The Public Prosecutor’s appeal request seemed poor from the motivational point of view, so much so that the Attorney General (representing the prosecution at this stage of the trial) asked at the end of the trial that the penalties imposed at the first degree trial be confirmed.

    The Court confirmed the acquittal of the person already acquitted for the location of the explosive device at the carabinieri barracks of San Giovanni and further acquitted him of the other charges. The anarchist previously sentenced for the Eni-Enjoy car-sharing vehicles set on fire had his sentence confirmed (1 year’s prison, suspended).

    The anarchist sentenced to 7 months in first instance was acquitted of all charges, while another three had their sentence reduced to 3 months following the acquittal of certain minor offences.

    The judges have the usual 90 days to file the grounds for the sentence.


    The umpteenth construction of the Prosecutor’s Office (or rather of the ROS) aimed at striking anarchism in our country has largely collapsed, due to the inconsistency not only of the specific evidence, judged insufficient for the purpose of conviction with regard to the offences but also of the prosecution itself that provided for the hypothesis of an association of a terrorist kind in line with the informal organisational proposals of the anarchist prisoner Alfredo Cospito. We welcome this ruling as it seems to us that it will remove a further piece of the net woven by the DNAA to try to isolate and silence Alfredo’s contributions, building a profile of “social danger” to justify his placement in the 41bis isolation regime.

    We smile in the face of this umpteenth failure of the State’s repressive projects, and take this occasion to greet all the anarchist and rebel prisoners locked up in every part of the world, all those who are struck by by judicial or police measures, or are under investigation, those on trial and all those who escape the meshes of power.
